Doylestown Retirement Community Celebrates One-Year Anniversary of Top of the Towers

As part of Chrysler's finalized bankruptcy plan, the company received an important immunity from the bankruptcy court: immunity against any future tort claims by consumers who had purchased vehicles before the company went into bankruptcy. Thus, on June 10, when the new Chrysler emerged from bankruptcy -- now owned by Fiat, United Autoworkers and the US and Canadian governments -- it did so with a clean slate.

The decision to allow Chrysler to avoid legal responsibility for any future product liability or other personal injury claims stemming from products sold before June 10 was a controversial one. Personal injury attorneys, consumer advocacy groups and Attorney Generals from at least 8 states all contested the bankruptcy court's decision. They argued that the bankruptcy court's ruling raised important constitutional questions about whether the court has the power to take away a person's future right to sue, particularly when the injury has not even occurred.

The opposition's arguments, however, were not successful and the court eventually granted the automaker the immunity it wanted, deciding that it would be unfair to make the new Chrysler responsible for any injuries caused by the old Chrysler.

In what many believe to be a peculiar twist, the new Chrysler has promised to uphold the warranties of any vehicles sold by the company prior to the bankruptcy. Many are left asking why Chrysler will agree to replace any defective parts on their cars but will not be responsible if one of those defective parts results in harm or even the death of a driver or passenger in a Chrysler vehicle.

Normally, when a person is injured in an accident and it is determined that a part or component of the vehicle was defective, thus causing the injury or worsening it, the person has the right to file a products liability claim against the manufacturer. At the time Chrysler filed for bankruptcy protection on April 30, it had approximately 300 such claims pending against it.

However, the new Chrysler can only be held responsible for any legal claims arising from products it sold after the bankruptcy. This means that if someone bought a Chrysler vehicle on June 9 and is subsequently killed because of a defectively manufactured part in the car, the person's family will have no legal right to sue the company for their loved one's death.

Further, the new Chrysler is not responsible for any of the legal claims pending against the company or that had been settled but not yet paid before the bankruptcy. All of those people were forced to take their place in the long line of unsecured creditors against the old Chrysler to fight over any assets that might be left over to pay their claims after the bankruptcy.

Many argue that the bankruptcy court could have taken a different route to ensure those with legitimate legal claims against the company were not left out in the cold. For example, the court could have handled the case in the same manner as the asbestos litigation was handled when the manufactures of the dangerous product went bankrupt. In the asbestos case, the bankruptcy court set up a victim compensation fund so that people at least received some type of remuneration for their injuries. However, it doesn't appear that this option was even seriously considered in the Chrysler bankruptcy, particularly when the company argued it had no money left to pay any of the legal claims pending against it.

Now, General Motors is seeking the same immunity protection in its fast-track bankruptcy filing and all indications seem to suggest that the biggest US automaker will get it. Between Chrysler and GM, the two companies are responsible for putting nearly 4.5 million cars on the road in 2008 alone. How many thousands of Americans may be harmed sometime in the future by one of these vehicles and be denied their right to compensation for their injuries?

Some consumer advocacy groups and certain attorneys have considered appealing the bankruptcy judge's ruling. Whether or not the appeal will result in any real change is yet to be seen. Until then, those who purchased Chrysler vehicles before this summer's bankruptcy ruling are left hoping that their cars will continue to keep their loved ones safe.

Types of Birth Injuries

- Erb's palsy
Erb's palsy is a form of brachial plexus palsy. It is caused by stretching the group of nerves located near the baby's neck, which control movement in the arms, hands and fingers. These nerves may be stretched during delivery, particularly in difficult deliveries when the baby is too large or in a breech position and it is necessary for the doctor to use force to remove the baby.

- Cerebral palsy
Cerebral palsy occurs when there is damage to the areas of the brain that control movement and muscle coordination. Most children who have cerebral palsy are born with it, but it also can be caused by infections and traumatic head injuries. Like Erb's palsy, cerebral palsy can vary in severity, with some children experiencing relatively minor symptoms and others with more serious symptoms requiring on-going medical treatment and rehabilitation.

Other birth injuries include:

- Broken collar bones
- Other broken bones and fractures
- Face hemorrhaging
- Eye hemorrhaging ( or "subconjunctival hemorrhage")
- Nerve injuries
- Bruising and lacerations
- Bruising and swelling of the scalp ("caput succedaneum")
- Bleeding underneath the cranial bones ("cephalohematoma")

Birth injuries can occur for many reasons. Physical conditions, such as the size of the child and the width of the mother's pelvis, can increase the potential for trauma during the birth. Infections also can cause brain injuries, which mistakenly may be attributed to a birth injury.

Birth injuries also can occur because of medical error, such as:

- The physician's failure to timely perform a caesarean (C-section)
- The physician's failure to monitor the fetus's heart rate
- Improper use of suction or forceps
- The physician's use of improper or excessive force during delivery
- The physician's failure to detect and/or treat a medical condition suffered by the mother during pregnancy

Bringing a Medical Malpractice Claim

In a medical malpractice claim, the plaintiff must be able to show that the physician did not meet the accepted standard of care when providing medical care to him or her, and that because of this failure, the plaintiff suffered an injury. The standard of care is determined by what other doctors would have done under the same or similar circumstances.

In birth injury cases, the physician may not be the only potential liable party. Depending on the facts, the hospital, nurses and other assisting staff may share some of the responsibility for the injury and may be named as defendants.
Medical malpractice cases can be difficult to prove and can take a long time to resolve. Generally, Obstetrician/Gynecologists (OB/GYNs) and other medical experts will be asked to testify about the established standard of care and provide evidence that the defendant physician failed to adhere to that standard, causing the birth injury to the child.

Florida Birth-Related Neurological Injury Compensation Plan

Due to increasing medical malpractice insurance rates for OB/GYNs, the Florida legislature passed the Birth-Related Neurological Injury Compensation Plan in an attempt to curb these expenses while still providing financial assistance to families with children suffering certain birth injuries.

According to the Plan, families may be entitled to limited compensation if the following conditions are met:

- The child suffers a catastrophic spinal or brain injury during labor, delivery or resuscitation following the birth
- The child's injury is caused by oxygen deprivation or mechanical injury (compression, traction)
- The child is permanently and substantially mentally and physically impaired because of the injury
- It was a live birth and the child weighed at least 2000 grams at birth

The Plan provides compensation regardless of the existence of fault on the part of the physician or others. In Florida, the Plan generally is the exclusive remedy for families with children who meet the criteria. This means that the families do not have the option of bringing a medical malpractice claim against the doctor.

However, certain exceptions apply that would still allow a family to bring a medical malpractice suit, including cases where the physician was not a participant in the Plan; where the physician did not provide notice to the family of his or her participation in the Plan; or in cases of "bad faith, malicious purpose or willful and wanton disregard of human rights, safety or property." "Birth injuries" refer to any injury the fetus and/or child suffers during labor and delivery. Some birth injuries are relatively minor and will heal over time. This Week's TV: Merlin spells magical entertainment!

How to take a "staycation"

    WAITSFIELD, VT, August 13, 2009 MaiMai News -- What's been a little more difficult for some is acting like you're on vacation when you're not technically away from your home for an extended stay. �Leave your cell phone off unless you need to use it - Your phone can be handy if you're traveling with other families or your group splits off into twos. So, leaving it home is not practical. Just make sure you don't take calls from anybody not in your vacation group. If you're curious or worried about an emergency, just check the voice mail they leave.

"If you were on a cruise ship, you wouldn't answer a call from the office. Your staycation deserves that same respect," said Hans. "Remember, you work hard for your time off and you owe it to yourself, your family and, believe it or not, your employer to come back rested ready with your batteries fully recharged."

Habitat For Humanity Gives Local Youth The Opportunity To Build A House With Their Spare Change

    LOS ANGELES, CA, April 29, 2009 MaiMai News -- Habitat for Humanity of Greater Los Angeles (HFH GLA) will be holding its Nickels for Nails Spring Fund Drive May 4th-15th. Nickels for Nails is a youth led initiative where participants receive fundraising suggestions, a coin collection container for their group and downloadable curriculum covering topics such as "What's in a home?" and "Economics, Government and Housing." Fundraising efforts in the past have included collecting change by recycling cans and bottles, as well as, hosting small fairs and carnivals. All of the funds raised during the week will go towards the $150,000 needed to build HFH GLA's second youth-sponsored home.

Continued Detention of Radio Host Hal Turner

    CHICAGO, IL, September 04, 2009 MaiMai News -- Hal Turner, the shock jock from North Bergen, New Jersey, was again denied bail despite the fact that the government provided no evidence of Mr. Turner being a danger to the community.

The government now seeks to adjourn the October 5th trial date, possibly subjecting Mr. Turner to a longer period of confinement. His attorneys', Nishay K. Sanan and Michael Orozco, have vehemently objected.

Given the administrative persecution that Turner has had and continues to endure in the SHU including not showering for nearly a week, having the caps on his teeth removed because they were deemed to be 'dangerous', only being allowed to communicate with his family once per month, two 15 minute phone calls to his attorney per week, segregated from the general population, being locked in his cell for 23 hours a day, no outdoor access, no TV, no radio and being subject to numerous de-humanizing searches and restrictions a "continuance would be tantamount to unjust and cruel and unusual punishment" stated Sanan.

Despite the fact that the FBI and Joint Terrorism Task Force, created, educated and funded the #1 "Hate Radio Host" in America the arrest and prosecution of Turner still constitute a fraud upon the court, as they are aware that they cannot convict Mr. Turner nor do they possess any evidence which shows that Mr. Turner intended to harm the judges involved in the alleged threats.

The American public should be outraged at how badly a man's constitutional and civil rights are being violated. Not everyone will agree with what Mr. Turner has to say, but everyone must agree that he has a right to say that which is protected. Penguin Announce Publication Of Vladimir Nabokov's Final Novel

    LONDON, ENGLAND, August 07, 2009 MaiMai News -- Penguin has announced the publication of "The Original of Laura", the final book by novelist Vladimir Nabokov, a novel which has been the source of much anxiety and contention for Nabokov's fans and his family.

The Original of Laura which exists on 138 index cards, was complete in Nabokov's mind, though he died before he could translate his vision onto paper. He asked for the manuscript to be destroyed, so his wife Vera, and later his son Dmitri, faced an agonising choice whether to publish the book or not. After three decades in a Swiss vault, "The Original of Laura", an extraordinarily beautiful novel, unprecedented in structure and style, will be published for the first time.

In Dmitri's introduction to his father's last novel, he recalls that it was only chance that saved an earlier book, "Lolita", from the incinerator. He has been guided by the precedent of that other book's survival in choosing to see "The Original of Laura" published.

Dmitri Nabokov, the son of Vladimir said: "When the task passed to me, I did a great deal of thinking. I have said and written more than once that, to me, my parents, in a sense, had never died, but lived on, looking over my shoulder in a kind of virtual limbo, available to offer a thought or counsel in order to assist me with a vital decision, were it a crucial mot juste or some more mundane concern. I decided at this juncture, that, in putative retrospect, Nabokov would not have wanted me to allow a new "Juanita Dark" - for that was an early working title of "Lolita", destined for cremation - to burn like a latter-day Jeanne d'Arc."

Vladimir Nabokov was born in St Petersburg. He wrote his first literary works in Russian, but rose to international prominence as a masterly prose stylist for the novels he composed in English, most famously Lolita. Between 1923 and 1940 he published novels, short stories, plays, poems and translations in the Russian language and established himself as one of the most outstanding Russian �migre writers.

Penguin will publish "The Original of Laura", as well as Nabokov's other titles about childhood and young love in November 2009, with the author's experimental novels and nonfiction, including a collection of unpublished poems to follow in spring 2010. Nabokov's satirical works and a previously unpublished collection of letters to his wife will be published in autumn 2010.

Anger Management Guru To Host Groundbreaking Anger Management Training in the State of Washington

    LOS ANGELES, CA, September 14, 2009 MaiMai News -- Anderson & Anderson will be hosting a three-day anger management training seminar at the King Oscar Hotel in Lacey, Washington on October 29 through October 31, 2009. One interesting thing about the location of this training is that it is not one of the typical locations where Anderson & Anderson provides its training. In fact, this will be the first time that Anderson & Anderson provides Anger Management training in the State of Washington. Family Life Skills, a company based in Washington, is co-sponsoring this training. The company has already guaranteed twenty new trainees. Anderson & Anderson will get thirty more potential trainees registered in order to reach the goal of having fifty, the maximum allowed for the facility that will be utilized.

The first day of training will focus on Adolescent Anger Management and will use the Anderson workbook "Controlling Ourselves" as the text. A demonstration and discussion of the Conover Assessment Component will be conducted. This one-day training is designed for Nurses, School Counselors/Psychologists, Substance Abuse Counselors, Case Managers, HR Managers, Clinicians, Probation Officers, as well as staff from group homes, and agencies serving families and youth. This curriculum is currently being used in school districts in Los Angeles, Oakland, Sacramento, Concord and San Diego, as well as school districts in Texas and Louisiana. In addition, probation departments in Arizona, Kansas, California and Texas use this model.

On the second day, Adult Anger Management will be examined. A demonstration of the Conover Assessment will be conducted with a discussion of its usefulness. "Gaining Control of Ourselves", in conjunction with experiential exercises and videos, will be used to initiate the participants to this intervention. Most major corporations have accepted this model for use by their Human Resources and EAP Managers, including the U.S. Department of Defense.

The third day of Training is Organizational Emotional Intelligence/ Anger Management. This training is designed to prepare the participant to offer workshops or presentations relative to anger management, civility or emotional intelligence a small group format. This is rapidly becoming one of the most requested interventions in anger management. This training has been conducted for Kaiser Permanente of Southern California, the Riverside County Medical Association as well as the Illinois State Bar Association.
