Students, Schools Get New 9/11 Course

Joint Custody Best For Kids After Divorce

Ohio residents who get into car accidents may face enormous financial losses through no fault of their own. Changes to the state's insurance laws have put every family at risk, and insurance companies have been allowed to expand what is known as the "intra-family" exception to uninsured motorist policies to unreasonable limits.

People purchase automobile insurance in order to protect themselves financially against injuries and damages they may cause to others. Additionally, people purchase uninsured motorist/underinsured motorist (UM/UIM) coverage in order to protect themselves and their family from damages caused by an uninsured or underinsured motorist.

In October of 2001, a bill known as Senate Bill 97 made a number of noteworthy changes in Ohio's insurance laws. The most significant change was the elimination of mandatory UM/UIM coverage. However, while UM/UIM insurance could still be sold, the new law allowed for insurance companies to exclude coverage under some circumstances. The law states in relevant part: (emphasis ours)

Any policy of insurance that includes uninsured motorist coverage, underinsured motorist coverage, or both uninsured or underinsured motorist coverage may include terms or conditions that preclude coverage for bodily injury or death suffered by an insured under specific circumstances, including but not limited to the following:

(1) The insured is operating or occupying a motor vehicle owned by, furnished to, or available for the regular use of a named insured, a spouse, or a resident relative of a named insured, if the motor vehicle is not specifically identified in the policy under which a claim is made. . ."

This exception is known as the intra-family, or "regular use" exception. The intra-family exception means an insurance company can deny UM/UIM coverage when the insured gets into an accident with a car that is not identified in the policy. So, if one is borrowing a car and gets into an accident with that car, the UM/UIM policy would not cover any losses or injuries.

Although the plain language of Senate Bill 97 explicitly limits the intra-family exception to vehicles not named in the policy, many, although not all, insurance companies throughout Ohio are selling policies that have enlarged the intra-family exception. Specifically, insurers are expanding the intra-family exception to include any motor vehicle owned by or furnished for the regular use of any family member. Unfortunately, Ohio courts have allowed insurance companies to widen the scope of the intra-family exclusion. The courts have reasoned that because the statute contains the language "including but not limited to the following", insurance companies can now limit UM/UIM coverage in any manner they see fit, including in ways that limit or contradict the exclusions that have been explicitly written into the statute.

The result of this reasoning has led to devastating results across the state. Now, every family is effectively uninsured if the family member driving the vehicle causes an accident and causes injuries to other members of the family. Bizarrely, non-family members or even total strangers who are passengers in a car that gets in an accident would be covered by UM/UIM, while family members of the driver would not be covered under the terms of the policy.

Most members of the public have no idea that their UM/UIM insurance may not cover their family if a member of their family causes an automobile accident. In fact, many insurance agents have no knowledge of this expansion in this unjust intra-family exclusion. When an individual purchases insurance for his or her family, they have little to no bargaining power with the insurance company. Most, if not all, insurance policies are "take it or leave it" propositions. Therefore, there is no way to for families to purchase additional coverage to protect family members in these situations. It is up to Ohio citizens to contact the legislature to pass new laws that specifically limit the intra-family exception. The more that people become aware of this burgeoning crisis, the more likely our legislature will take action.

Carolina Tire to Cater to South Charlotte Women

That's the future that Carolina Tire & Service Center, (www.Carolina-Tire.com) sees for the automobile repair industry. After all, women are more likely than men to be the ones who bring the family car to the company's shop.

The South Charlotte company plans to open 9 stores during the next nine years, bringing its total to 10 locations, all catering to mainly women drivers. All ten of those stores will be in metro South Charlotte. The first one opened November 2008 in Pineville. Company officials are now scouting for new locations.

Designed by XL Tire, Inc., the same company that designed online companies www.BadBoyTires.com and www.JimmysVacations.com, a Carolina Tire repair shop more resembles a department store or salon more than a car service center.

The shops have soft colors and lighting, music plays in the background, tires are kept in simple displays instead of stacked on the floor and large glass doorway provides a view of the mechanics working on the cars. The waiting room has a large couch and lather chairs instead of metal chairs, free gourmet coffee, magazines such as "O" and "Red Book," an interactive computer to see how the family car will look with different tires and a playroom for the kids.

"There's nothing else like it in the United States," said Jim Seidel, president and CEO for Carolina Tire. "We aren't just marketing to their cars but to their hearts and minds."

Marketing plans include forming partnerships with department stores to promote cosmetics and local beauty shops to provide manicures, Seidel said. Their largest marketing event will being giving away Free TomTom GPS's during this June & July with the purchase of 4 Continental tires. The store also will provide seminars to teach women how to care for their cars, he said.

Carolina Tire, which was originally Pineville Tire was purchased by XL Tire, Inc., which in run by Jim Seidel, an executive in the tire & automotive industry who has traveled all over the globe within the business.

Recently, the company noticed that the majority of their customers were women. By January of this year, they had redesigned the store to accommodate women. The woman's bathroom is stocked with wipes, diapers, hand sanitizer and hand lotions. Their children's playroom is a Disney's Finding Nemo themed room with clean kid friendly toys and games that are sanitized on a daily basis. Their best addition is hiring a woman for the sales counter to better help customers. Stephanie Mackin, a recent graduate from the NASCAR Technical Institute was hired in January 2009. "Stephanie has a unique perspective and background that enables her to better translate automotive repair issues to both men and woman," Seidel added.


Last October, the company worked with local banker BB & T to take the concept to Pineville. Carolina Tire is focusing its efforts in the suburbs of fast-growing South Charlotte and Northern South Carolina.

Industry observers like Carolina Tire's strategy.

A recent survey by the American Woman Road & Travel magazine showed that women are the fastest-growing segment of consumers for car repair shops. Sixty-five percent (65%) of women take their own vehicles to a repair shop for service. Some repair industry experts estimate that the average may actually be closer to 80%, according to the magazine's survey.

"The shops who don't find a way to cater to women will have trouble staying in business," said Courtney Caldwell, publisher and editor in chief of the Internet-based magazine. "It's like having a relationship and women are very relationship-oriented."
Most car manufacturers and dealerships have committees that look for ways to better accommodate women, Caldwell said. Now the trend is reaching the independent repair shops, she said.

"Women aren't looking for special treatment, just respectful treatment," she said. "It's the best advertising a shop can do. Each woman will tell 20 friends."

Built for Women

Traditionally, women have been uncomfortable dealing with mechanics because of their lack of automotive knowledge and the stereotype that mechanics will take advantage of them, Caldwell said.

Repair shop owners have begun accommodating women in the past several years by providing cleaner facilities and eliminating the calendars with pictures of scantily clad women that once were a hallmark of shops, said Trish Serratore, vice president of industry relations for the National Institute for Automotive Service Excellence, a nonprofit organization that trains and certifies car mechanics.

"Repair shops are recognizing the fact that women are the ones bringing in the cars," Serratore said. "They are updating their facilities."

Raul Molina, Jr., Second-Generation Restaurateur, to Receive Top Honor from Texas Restaurant Association

    HOUSTON, TX, June 11, 2009 MaiMai News -- Raul Molina, Jr., the second of three generations to own and operate Molina's Cantina, will be inducted into the Texas Restaurant Association's Hall of Honor on June 29 at the association's annual President's Gala at the Southwest Foodservice Expo in Dallas. Voted in by a committee of peers within the Texas restaurant industry, the Hall of Honor is the highest recognition members of the TRA can achieve.

"He's one of the most dedicated people in the foodservice industry in Houston," said son Ricardo Molina, who now owns and operates the family restaurants with brothers Raul and Roberto and currently serves as immediate past president for the Greater Houston Restaurant Association. "He made us very proud, as an employer, mentor and father," added son Raul. "He worked seven days a week, but somehow he was always there for us."

As Hall of Honor inductee, Molina, Jr. will be acknowledged for his commitment to the foodservice industry, the association and his community, as well as for his outstanding leadership, exemplary business ethics and ability to promote a positive image of the foodservice industry in Texas. Molina's Cantina is Houston's oldest Tex-Mex restaurant, family owned and operated since 1941 and thriving after 68 years in one of the country's most competitive dining cities.

"The family ethic on how to run a restaurant is best epitomized by Raul Molina," said Jim Berly, a longstanding Molina's customer. "His passion for serving a great product bodes well for him."

Raul Molina, Jr. was just twelve years old when he started working in his parent's first restaurant, Old Monterrey, located at 1919 W. Gray. The family lived in a single room above the restaurant. At that time there were five or six Mexican restaurants in Houston. "I worked my way up, from busboy and dishwasher to food prep, then finally front-of-the-house, waiting tables and managing staff," said Molina, Jr.

After graduating from St. Thomas High School in 1949, Molina, Jr. attended the University of Texas School for Hotel and Restaurant Management before joining the Army and being deployed to France and Germany. After serving two years in the Army, he reunited with his father and brother George to work once again for the family restaurants.

In 1977 Molina, Jr. acquired full interest in the restaurants from his father, Raul Molina, Sr., now considered one of the pioneers of Tex-Mex cuisine (along with Mi Tierra of San Antonio, Joe T. Garcia's in Fort Worth and Matt's El Rancho in Austin). For the next 22 years, until his retirement in 1999, Molina, Jr. continued the restaurant's long history of providing fabulous food, attentive service and commitment to taking care of his employees.

"Mr. Molina is a role model," said Johnny Brefro, a kitchen manager who has been with Molina's for 25 years. "He taught us to never underestimate anyone, respect everyone and understand each other's obligations to the company." A decade after his retirement, many of the employees Molina, Jr. hired continue to work for Molina's Cantina, his legacy and influence on Houston's culinary scene still evident.

"Whatever you choose to do in life, you have to enjoy it. I loved going to work and taking care of our customers," said Molina, Jr., who is now a cattle rancher in Anderson, TX. "I've had a good life in the restaurant industry."

Marijuana: What Is It And Is It Legal In The State Of Florida

    July 03, 2009 MaiMai News -- Marijuana is illegal in the state of Florida and is heavily prosecuted in the central Florida areas of Orlando, Winter Park, Windermere, Kissimmee, Longwood, Altamonte Springs, Tuscawilla, and in Orange, Osceola, Seminole, Brevard and Lake County. What is Marijuana?

Does Marijuana Affect the Brain?

When a person smokes pot, THC rapidly passes from the lungs into the bloodstream, which carries the chemical to the brain and other organs throughout the body.

THC acts upon specific sites in the brain, called cannabinoid receptors, initiating a series of cellular reactions that ultimately lead to the "high" that people experience when they smoke marijuana. Some brain areas have many cannabinoid receptors; others have few or none. The highest density of cannabinoid receptors are found in parts of the brain that influence pleasure, memory, thoughts, concentration, sensory and time perception, and coordinated movement.

Cannabis intoxication can cause distorted perceptions, impaired coordination, difficulty in thinking and problem solving, and problems with learning and memory. Research has shown that marijuana's adverse impact on learning and memory can last for days or weeks after the acute effects of the drug wear off. Research on the long-term effects of marijuana abuse indicates some changes in the brain similar to those seen after long-term abuse of other major drugs.

Marijuana abuse can lead to addiction; that is, compulsive drug seeking and abuse despite its harmful effects upon social functioning in the context of family, school, work, and recreational activities. Long-term marijuana abusers trying to quit report sleeplessness, irritability, anxiety, decreased appetite, and drug craving, all of which make it hard to quit.

Can Marijuana affect mental health?

A number of studies have shown an association between chronic marijuana use and increased rates of anxiety, depression, suicidal ideation, and schizophrenia. Some of these studies have shown age at first use to be a factor, where early use is a marker of vulnerability to later problems. However, at this time, it not clear whether marijuana use causes mental problems, exacerbates them, or is used in attempt to self-medicate symptoms already in existence.

What Other Adverse Effect Does Marijuana have on the body?

There is a study that found that an abuser's risk of heart attack more than quadruples in the first hour after smoking marijuana. Other studies have shown marijuana smoke to contain carcinogens and to be an irritant to the lungs. In fact, marijuana smoke contains 50 to 70 percent more carcinogenic hydrocarbons than cigarette smoke. Pot smokers can have many of the same respiratory problems as tobacco smokers, such as daily cough and phlegm production, more frequent acute chest illness, a heightened risk of lung infections, and a greater tendency toward obstructed airways.

What Treatment Options exist if you get arrested for smoking marijuana?

Behavioral interventions, including cognitive behavioral therapy and motivational incentives (i.e., providing vouchers for goods or services to patients who remain abstinent) have shown efficacy in treating marijuana dependence. Although no medications are currently available, recent discoveries about the workings of the cannabinoid system offer promise for the development of medications to ease withdrawal, block the intoxicating effects of marijuana, and prevent relapse.

Although the total number of drivers without insurance has declined nationally in the last few years, the economic downturn is forcing families to make tough financial choices. Unfortunately, this often results in an unpaid car insurance bill.

The Insurance Research Council found a direct correlation between rising unemployment rates and an increase in uninsured drivers. The Council estimates that if the economy does not improve by 2010, one out of every 10 drivers in the country will not have auto insurance.

In Minnesota, 12% of all drivers do not have car insurance. This places other drivers at an increased risk of an accident with an uninsured driver. So what can responsible drivers do to protect themselves from uninsured motorists?

Minnesota is a No-Fault insurance state. This means that anyone involved in an accident can make a claim under his/her own insurance policy for payment of medical bills and/or wage loss, regardless of who is at-fault for the accident. All car insurance policies in the State of Minnesota include personal injury protection (PIP) benefits. At minimum, PIP benefits must pay up to $20,000 in medical expenses and up to $20,000 in non-medical expenses such as lost wages per accident, per person.

Uninsured and Underinsured Motorist Coverage

In addition to requiring No-Fault coverage for payment of medical bills related to an accident, Minnesota law requires all drivers to carry minimum levels of uninsured (UM) and underinsured motorist coverage (UIM).

Uninsured (UM) coverage covers you when an at-fault driver fails to carry automobile insurance. Whether or not another driver has insurance will not affect your ability to recover money for your injuries, pain and suffering, unpaid medical bills, unreimbursed wage loss, or any other out of pocket expenses related to an accident.

Underinsured (UIM) coverage covers you when an at-fault driver does not have enough insurance to adequately compensate you for injuries sustained in an automobile accident. For example, if a Minnesota insured driver causes an accident and only has the minimum $30,000 liability limits that the State requires, you can then turn to your own insurance coverage for this extra "underinsured" coverage.

The minimum required amount of UM/UIM coverage in Minnesota is $25,000 for injuries to one person and a maximum $50,000 for injuries to two or more persons per accident. However, these minimums are not likely to provide enough coverage if you are involved in a serious accident resulting in severe injuries. Brain, spine and other serious injuries can result in hundreds of thousands of dollars in medical expenses and lost wages can sink any person or family, no matter how much money you earn.

We recommend that all Minnesota drivers increase these relatively inexpensive coverages to at least $250,000 per person, $500,000 per accident.

UM and UIM coverages are insurance on yourself - think about it like disability insurance or life insurance. These coverages take care of you, your family members, and anyone else riding in your car at the time of an accident. If you are adequately protected, you do not need to worry about whether other drivers on the road are carrying sufficient insurance.

Once again, drivers should purchase additional UM/UIM coverage that provides a minimum coverage of $250,000/$500,000.

It is important to remember that UM/UIM coverage will pay you for your pain and suffering, unpaid medical bills over and above the $20,000.00 PIP maximum, unreimbursed wage loss, future loss of earning and all other damages.

However, while UM or UIM coverages protect you, they do not protect your car. Therefore, if you are involved in an accident with an uninsured driver, you can lose your car if it is a total loss and you do not have collision coverage on the vehicle. To ensure you have insurance coverage for any damage to your vehicle, you should carry collision coverage, which specifically pays for car repair and replacement costs. The other unfortunate aspect of getting in an accident with an uninsured driver is that you will likely be out your deductible. Make sure your deductible is low enough that you can afford to pay it during a time of need.

Stacking Policies

Married couples who own at least two cars should always stack their insurance policies. Your insurance company may not tell you about stacking, but it is allowed and should be utilized in Minnesota. Stacking allows you to double the minimum personal injury protect (PIP) coverages in Minnesota. For example, instead of having $20,000 available in medical expense coverage, stacking will give you $40,000 in potential coverage.

In addition, stacking increases the weekly wage loss maximum from $250 per week to $500 per week. Very few individuals can live off of only $250 per week. The weekly wage loss amount of $250 has not been increased since the No-Fault Law was put into place in the early 1970s. The extra $1,000 per month in wage loss that stacking provides can be the difference between sinking and swimming.

A major accident with an uninsured or underinsured driver can wipe out your savings and rack up thousands of dollars in medical bills. With this in mind, it makes sense to have all of the coverage you can get, and stacking is very inexpensive considering how much extra coverage you get for it.

Umbrella Policies

Umbrella polices provide additional liability coverage in the event you are responsible for an accident, but do not have enough liability insurance to cover the costs of the other party's damages. They do not provide additional coverage for any injuries or damages you may suffer.

Umbrella policies are only necessary if you have significant assets you want to protect from the possibility of a personal injury lawsuit. Most people involved in car accidents only seek recovery from any available insurance policies and do not pursue personal assets. So unless you have significant wealth to protect, an umbrella policy may not be the best option. Instead, you should spend the extra money purchasing additional UM/UIM coverage.


With the economy in a downturn, more and more drivers are just carrying the state required minimum insurance coverages or even no insurance at all.

Therefore, it is essential that Minnesota drivers have sufficient UM/UIM coverages. You cannot control whether or not another driver has insurance, but you can control whether or not you have enough insurance to protect you and your loved ones.

NAPO Encourages People to Get Ready During National Preparedness Month, September 2009

This year, NPM will focus on changing perceptions about emergency preparedness and will help people understand what it truly means to be ready for emergencies that may arise at home, at work, or in the world. Preparedness goes beyond fire alarms, smoke detectors, dead-bolt locks, and extra food in the pantry. Being Ready includes: preparing an emergency supply kit, making a family emergency plan, being informed about emergencies and their appropriate responses and getting involved in community efforts.

Some tips for preparing an emergency plan at home:
oSpeak to your children's school about their shelter-in-place and/or evacuation plans
oDetermine what types of disasters, both natural and man-made, are most likely to occur in your area and how you will be notified
oIf your cell phone was inoperable, determine how you would you get in touch with family
oDevise a family meeting place and an out-of-town contact
oPrepare a small kit with emergency supplies that you keep at home, in your car, or at work in case of an evacuation

Some tips for preparing an emergency plan at work:
oKnow the evacuation plan at your job
oKnow what kinds of emergencies might affect your place of employment, both internally and externally
oLearn about what to do during a biological, chemical, explosive, nuclear or radiological attack
oInclude emergency preparedness information in newsletters, on company intranet, periodic employee e-mails and other internal communications
oPut together a portable kit customized to meet personal needs, including essential medications. The kit should also include water, at least a three-day supply of non-perishable food and a can opener for canned goods; a battery-powered radio and extra batteries; a flashlight and extra batteries; a first aid kit; a whistle to signal for help; dust or filter masks; moist towelettes for sanitation; a wrench or pliers to turn off utilities; plastic sheeting or duct tape to seal the room; and garbage bags and plastic ties for sanitation

New research from uSwitch.com reveals that 31 million (73%) shoppers are taking matters into their own hands by opting for supermarket own brand labels in a bid to save money on the weekly shop. This figure has tripled since August 2008 when just a quarter (25%) of shoppers were ditching premium labels to lighten the financial load of the weekly trolley dash.

Much of this increase can be attributed to supermarkets expanding their own brand products in a bid to stop consumers switching to cheaper chains. This includes the launch of the Waitrose 'Essentials' own label range, Tesco's 'Discounter' range and Sainsbury's 'switch and save campaign' which calculates own brand savings. Not only has this activity secured repeat visits from existing customers, according to the recent TNS Worldpanel report it has also slowed the rapid growth of overseas competitors such as Aldi, Iceland and Lidl over the past few months.

Overall, this research has revealed that nine out of ten (90%) UK adults now use recession-busting shopping strategies when they do the weekly shop. Money off vouchers have also reached the top of the shopping list with the number of frugal consumers' regularly using these has also shot up to 74%, compared with 26% last year. In addition, a fifth of shoppers (20%) now compare prices online before taking a trip down the aisles, this has more than tripled from just 6% in August 2008.

When it comes to shopping online 6.4 million consumers now claim to avoid the hustle bustle of their local supermarket by carrying out their weekly food shop online. Again, this has tripled from just 5% of consumers in August 2008. In fact, this is becoming so popular with consumers, industry commentators predict that the value of online food sales could hit GBP8 billion by 2011.

These recessionary cut backs could also have positive lifestyle implications for many savvy shoppers as they revert to the good life. Almost a fifth of consumers have now taken to growing their own fruit and vegetables, up from just 8% in August 2008. This has created a waiting list for allotments across the country amongst those who do not have the option at home. Just this week, Tesco has applied for planning permission to create allotments for rent at its Dobbies Garden Centre - they also plan to sell allotment starter kits.

As a result of 'pinching the pennies' becoming very much the new 'splashing the cash', figures suggest supermarkets may turn out to be one of the few winners in the recession. For example, Morrisons has just surprised the market with an unscheduled trading update indicating full year profits would be GBP70 million ahead of expectations. Share prices in Sainsbury's and Tesco have also experienced a rise.

Rumina Hassam, personal finance expert at uSwitch.com, says: "In the face of uncertain economic forecasts, continued volatility in the housing market, and worrying increases in national unemployment, Brits are making savvy cutbacks to their fundamental spending routine to beat the recession at its own game.

"The number of Brits making basic changes to their weekly food shopping patterns has increased dramatically since last year, as the effects of the recession continue to amplify. However, despite the economic outlook remaining uncertain, consumers may find they have the last laugh - as the lessons learnt from the schooling in savviness they are currently experiencing as a result of the recession will remain vital, even long after the economy recovers."

Rumina's 10 thrifty trolley tips:

1.Switch to a credit card from a supermarket. You can earn extra loyalty points and often get 0% on purchases in store for a period of time.

2.Tesco credit card: Make purchases from a range of selected items at Tesco Direct using your Tesco Credit Card, interest free, for a fixed number of months. 5 points for every GBP4 you spend at Tesco or Tesco.com and 1 point for every GBP4 you spend elsewhere.

3.Sainsbury's credit card: Earn 4 points per GBP1 spent when using card in conjunction with Nectar card in Sainsbury's store, 2 points per GBP1 when only using card. Earn 1 point per GBP5 spent when making any other purchase. Enjoy 0% for the first 12 months on Sainsbury's shopping.

4.Asda credit card: Quadruple points are earned for the first 3 months and every December when you shop at Asda. Double points are earned everywhere else you use your card for the first 3 months and each and every time you shop at Asda. And you'll earn single points every time you use your card outside of Asda. Also a 5% discount at ASDA Living stores.

5.Always use your reward/loyalty cards such as Tescos, which allow you to collect points while you shop.

6.Humble pie never tasted so good - switch down a brand and you could save 15% off a family shop over year, potentially saving GBP800.

7.The late bird gets the worm - switch to shopping at night and you'll be much more likely to bag a bargain as supermarkets make big reductions on items near their sell-by dates. Generally these reductions start at 7pm.

8. Don't shop while hungry. Eat before you leave home so you won't be as tempted to buy more than you need.

9.Shop with a list. Allow yourself to buy off-list items only if they're unadvertised specials at prices too low to pass up.

10.Cook more from scratch. Pre-packaged items save time, but that convenience comes at a price.
